After having handled thousands of cases and hundreds of criminal trials in my career, the one thing I can tell you about these charges is that you want to avoid being convicted if at all possible. If convicted of a misdemeanor assault charge, you could face up to six months in jail on a first offense. If the assault is against a woman, child, police officer, fireman, teacher, or infirm or disabled person it can be filed as a felony and jail or prison time can be imposed as a penalty. If a dangerous weapon was used or serious physical injuries are involved, the prosecutor can file an allegation of dangerousness, which greatly increases the penalties with mandatory prison time.
