A conviction related to domestic violence, spousal abuse or a family assault has serious potential consequences. Realizing this, many spouses or partners will try to drop the charges. When they do, they are often surprised to learn that the decision to drop the charges is not theirs to make. That decision now belongs to the prosecutor. I first try to get the case dismissed. If the prosecutor will not dismiss, then I try to get a lesser charge or a diversion program. If you have a good case we can always go to trial.
The prosecution in Domestic Violence cases refer to the threaten or injured person as the victim. Sometimes the police charge the wrong person and often the victim is the person who instigated the fight or altercation and is as much at fault as the defendant. The victim may even have been the aggressor so I usually raise the defense of " SELF DEFENSE" If the Judge or Jury believes that the defendant acted in self defense then he or she is found not guilty.
