When a Domestic Violence Arrest
Becomes a Domestic Violence Conviction
Attorney Larry G. Ruch — Phoenix, Arizona
While not every domestic violence arrest is going to produce a conviction, consequences are likely to be suffered just the same. The fact of the matter is that an arrest can have serious nonlegal consequences — even if you are not ultimately convicted.
If a recent domestic violence arrest has led to the filing of criminal charges against you — contact my Phoenix, Arizona, law offices for a free consultation. I can help.
The Nonlegal Consequences of a Conviction
A domestic violence arrest and conviction can mean a lot to a prospective employer or to any number of other people. While many will deny it, the truth is that these people will look at you differently and treat you differently once they find out. This can cost you as much as or more than any sentence might impose. However, an expungement of your record may be possible and is another service I can help you with.
The Legal Consequences of a Conviction
As a criminal defense lawyer, I have been working to protect the rights of the accused in Central Arizona for over 35 years. In that time, I have handled approximately 250 trials and virtually every type of domestic violence-related charge there is. What I can tell you about sentences, generally, is that the sentence a person actually receives may vary depending on the crime or crimes charged, the unique facts and circumstances involved, and other factors. What I can also tell you is that sentences are not growing more lenient; they are getting tougher.
Typically, conviction on an assault or battery charge stemming from domestic violence will be classified as Class 1 misdemeanor and carry up to a six-month sentence. Probation or a diversion program may also be realistic options which, if completed, could allow you to put this all behind you with very little damage done. Also, unlike most defense lawyers I do not charge additional attorneys fees if a trial is necessary in your case.
